At 2 Sodas, we take your privacy, and our responsibility to care for it, seriously. This policy describes how 2 Sodas, Inc. (“2 Sodas”, “We,”, “Our”, or “Us”) processes the personal information we collect about you when you use our games, platforms, web sites, community features, events, or other services (collectively "Service" or "Services").

 

1. Information We Collect

 

We collect information that you give us directly, that you provide when using our Services, and from third parties who partner with us to provide Services. 

We will process information about you where we have your consent, where we have a legitimate interest to do so, where the processing is necessary for the performance of a contract with you, and/or where we have a legal obligation to process your information. 

We collect information that you provide us directly, such as your account information (such as name, user name, email, phone), security information, survey responses, or information you provide when seeking support (like screenshots).

 

When you play our games, your Account and profile information, gameplay, and other statistics are collected.  Some information and statistics may be visible in-game, or available to view outside of the game, to you and other players (for example, on a Leaderboard).

 

When you use our community or social features, any text, audio, visual, and/or other electronic communications information that you disclose may be read, copied, collected, or used by other players, and may become publicly available.

 

We may collect and store other information automatically (either locally or remotely) when you use our Services, such as you IP address, device hardware, software and event information, location, browser information and interactions with our web content, download and purchase information.  

 

We may receive information about you from third parties. For example when you use third-party social platforms (such as Discord) we may receive information associated with your account on those platforms, or if you play or purchase our games in a third-party app store or platform, we may receive information from those providers. 

 

2. How We Collect Your Information

 

We use various technologies to deliver and measure the effectiveness of our Services, and to enhance your player experience.

 

We and third parties use various methods to collect information to deliver our Services, to measure Service interaction and effectiveness, to enhance your experience, or to maintain compliance with our Terms of Service, including but not limited to cookies, tracking pixels, log files, internal and third-party analytics, and anti-cheat or anti-fraud techniques.

 

3. How We Use Your Information

 

We use your information to operate our Services, to improve your game experience, to provide you customer support, to serve and measure the effectiveness of our marketing communications, and to personalize our communications with you.

 

We use your personal information in the following ways:

 

  • To operate our business, including to improve our games and Services, conduct marketing campaigns, detect and respond to security incidents, maintain compliance, comply with the law, and maintain a safe and fair Service environment. 

  • To enhance your game experience, including to better understand our players, populate leaderboards, enable onling matchmaking, facilitate social sharing, maintain accounts, personalize your experience, and to address bugs or errors.

  • To provide support, including to identify and troubleshoot problems, collect player feedback, communicate directly with you, send you important updates about your account and Services.

 

We retain the information we collect for as long as necessary to provide our Services, and we may retain that information beyond that period, if necessary for legal, operational, or other legitimate reasons.

4. Who May Receive Your Information

 

We may disclose your personal information to certain third parties.  We do not sell your information.

 

We may disclose your personal information to vendors or other service providers for purposes consistent with this policy.  2 Sodas does not sell your information to any third party. 

 

We may access, preserve, and disclose any information we store associated with you to external parties if we, in good faith, believe doing so is required or appropriate to: comply with law enforcement or national security requests and legal process; protect your, our or others' rights, property, or safety; enforce our policies or contracts; collect amounts owed to us; or assist with an investigation or prosecution of suspected or actual illegal activity. 

 

In the event of a reorganization, divestiture, merger, sale, or bankruptcy, we may transfer all information we collect to the relevant third party.

 

We may disclose your information to other recipients with your express consent, unless otherwise described above. For example, you may agree to us sharing your information to hear about related products, services, or promotions. 
 

5. Where We Hold Your Information 

 

We store and process your information in the United States and other countries where we operate. 

 

When you access our Services, your personal information is generally collected by us directly and processed in the United States. By consenting to the transfer of your personal data outside of your country of residence, you acknowledge that your personal information may be transferred to recipients in the United States and other countries that may not offer the same level of privacy protection as the laws in your country of residence or citizenship.

We use a range of security measures to secure and protect your information.

 

Security of your information is a priority at 2 Sodas.  We take various technical and organizational measures to help protect it, including encryption of sensitive information. However, no security measure is infallible and we cannot always guarantee the security of your information. You should also be diligent when it comes to the protection of your personal information.

Our websites and Services may contain links to third-party services and sites.

 

Our websites and Services may contain links to third-party services (such as a Discord community). If you click on those links you will leave the Service and go to the third-party service or site that you selected. If you visit a third-party website or use a third-party service, you should consult that service's or site's privacy policy as your use of third-party sites or services is governed by their privacy policies.

 

8. Changes to Our Policy

 

This policy will be updated from periodically.  We will notify you if any changes are material. 

 

We may occasionally update this privacy policy. When we do, we will revise the "last updated" date at the top of the policy. If there are material changes, we will use reasonable efforts to post a notice or directly send you notification before such changes take effect.

By using any of our games or services, you agree to these terms.  If you do not agree, do not use any of our games or services.

 

Welcome to 2 Sodas. This Agreement governs your access and use of products, content, and services offered by 2 Sodas, Inc., its partners, parent companies, subsidiaries, and affiliates (collectively “2 Sodas”, “We,”, “Our”, or “Us”), such as game software and related updates, upgrades and features, and all online and mobile services, platforms, websites, community features, and events hosted by or associated with 2 Sodas, Inc. (collectively “Service” or "Services"). This Agreement constitutes a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and 2 Sodas, Inc., concerning your access to and use of the Services.

 

Supplemental terms and conditions or documents that may be posted on the Services from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to this Agreement at any time and for any reason.  We will alert you about any changes by updating the "Last updated" date of this Agreement, and you waive any right to receive specific notice of each such change.  It is your responsibility to periodically review these Legal Terms to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Agreement by your continued use of the Services after the date such revised Agreement is posted.

 

Your use of our Services is also subject to the 2 Sodas Privacy Policy, which is also incorporated by reference into this Agreement.

 

BY USING 2 SODAS SERVICES, YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE, DO NOT INSTALL OR USE THE SERVICES. FOR RESIDENTS OF CERTAIN COUNTRIES, YOU AGREE TO THE ARBITRATION AGREEMENT AND CLASS ACTION WAIVER DESCRIBED IN SECTION 10 TO RESOLVE ANY DISPUTES WITH 2 SODAS.

 

1. Account and Access

 

You may need an Account, or one may be created for you, in order to play games or access other Services. To create one, you must be at least the minimum age. Your parents must read and agree to these terms if you are a minor. 

 

You may need an Account, or one may be created for you, in order to play games or access other Services.  To create an account and use Services, you must meet the following requirements:

 

  • Be eligible to use the Services for which you are registering.

  • Be a resident of the country where use of the Services is permitted.

  • Be of minimum age in your country of residence.

  • Provide truthful and accurate personal information, if asked to provide it.

  • Parents and guardians are responsible for the acts of children under 18 years of age when using the Services. 

 

You are responsible for the activity on your Account.  Your Account should not be shared, accessed, or used by anyone else. Your Account may be suspended or terminated if someone else accesses or uses it to engage in activity that violates this Agreement.

 

2. License

 

Our Services are licensed to you for personal use, not sold. 

 

The Services are licensed to you, not sold. 2 Sodas grants you a personal, limited, non-transferable, revocable, and non-exclusive license to use the Services to which you have access for your non-commercial use, subject to your compliance with this Agreement. You may not access, copy, modify, distribute, reverse-engineer, or otherwise use any Service, Content, or Entitlements (as those terms are defined below), unless expressly authorized by 2 Sodas or permitted by law. 2 Sodas or its licensors own and reserve all other rights, including all right, title and interest in the Services and associated intellectual property rights.

 

3. Content and Entitlements

 

2 Sodas Services include access to Content, including User-Generated Content, and Entitlements.  Some access may be unlocked using virtual tokens that have no value outside of the Services.

 

2 Sodas Services include access to Content and Entitlements. All Content is either owned by 2 Sodas or its licensors, or is licensed to 2 Sodas and its licensors.

Content

 

Content is the design, appearance, and capability of all software, technology, text, forum or chat posts, profiles, widgets, messages, links, emails, music, sound, graphics, pictures, video, code, web sites and all audiovisual or other material appearing on, or coming from, our Services. Content also includes User-Generated Content ("UGC"). 

User-Generated Content

 

UGC is content such as Account profiles, forum posts, art or other Content contributed by users for use within the context of the Service. You are responsible for your UGC.  It must be content to which you have intellectual property rights, and does not otherwise violate the law, or another person’s rights, or this agreement.

When you contribute UGC, you grant to 2 Sodas, and its licensors and licensees, a non-exclusive, perpetual, transferable, worldwide, sublicensable license to use, host, store, reproduce, modify, create derivative works, publicly perform, publicly display, or otherwise transmit and communicate the UGC, or any portion of it, in any manner or form and in any medium or forum, whether now known or later devised, without notice, payment or attribution of any kind to you or any third party. You also grant to all other users who can access your UGC on a 2 Sodas Service the right to use, copy, modify, display, perform, create derivative works from, and otherwise communicate and distribute your UGC on or through the Service without further notice, attribution, or compensation to you.

 

2 Sodas may, in its sole discretion, remove, edit, or disable UGC for any reason, including if we reasonably suspect or determine that UGC violates this Agreement, regardless of whether it actually violates this agreement. 2 Sodas assumes no responsibility or liability for UGC, or for removing it, or not removing it or other Content from the Service. 2 Sodas does not pre-screen, filter, moderate, endorse, or approve any UGC available on the Services. 

Entitlements

Entitlements are rights that 2 Sodas grants to you via a personal, limited, non-assignable, non-exclusive, revocable license to access or use certain elements of the Services, for example access to digital Content, functionality, codes, or virtual currencies. Entitlements have no monetary value, and no value outside of the Services.

4. Availability and Updates

 

2 Sodas Services may not always be available or operational.  We may also make updates or changes at any time, which could impact your access, profile, progress, or history.

 

We do not guarantee that any Service, Content, or Entitlement will be available at all times, or in all locations, or on all platforms, or on all devices, or via all Internet or connection providers. We do not guarantee that we will continue to offer a particular Service, Content, or Entitlement for any particular length of time. 

 

From time to time, we may update, modify, or reset Services, Content or Entitlements, or certain parameters therein, without notice to you. These changes may impact Service availability, your account, profile, progress, history, or other elements. 2 Sodas does not guarantee support for previous application versions once a new version is made available.  

 

2 Sodas may take actions without notice to you, to protect you or 2 Sodas, such as preventing unauthorized access, resetting passwords, suspending access, deleting data or removing Accounts.  Your access to Services may also be affected in response to actual or suspected Rules of Conduct violations.

 

5. Rules of Conduct

 

We want every player to have fun in a safe environment.  As such we expect every player to respect other players, and 2 Sodas employees, representatives, and Services, at all times. To ensure compliance with these rules, we may monitor your activity. If you don’t follow these rules, we may remove your access, account, or content from the Services, temporarily or permanently.

 

When you access or use our Services, you agree that you will not:

  • Violate any law, rule, or regulation.

  • Interfere or disrupt any Service, server, network, computer, or other property via any technological, social engineering, or other method.

  • Distribute any Content or UGC, or engage in any other activity that is inappropriate, abusive, harassing, profane, threatening, hateful, offensive, vulgar, obscene, sexually explicit, defamatory, discriminatory, illegal, infringing, unwanted, invades another's privacy, or is otherwise objectionable.

  • Use the Services for any purpose other than personal entertainment and communication. 

  • Impersonate another person or falsely imply that you are a 2 Sodas employee or representative.

  • Make false reports or complaints about the Services.

  • Attempt to obtain private account or security information from anyone else on our Services.

  • Use any automated device or method to access Services for any purpose such as scraping data, abusing Services, account creation, copying material, or manipulating game play.

  • Use or distribute any tool or method to cheat, collude, or otherwise gain unfair advantage within the Services.

  • Intentionally obfuscate your network connection or location while connected to Services

  • Use our Services in a country in which 2 Sodas is prohibited from offering such services.

  • Promote, encourage, or participate in any prohibited activity described above.

 

The determination of whether you or someone using your Account has violated any Rule Of Conduct, and what action shall or shall not be taken in response, is the sole discretion of 2 Sodas. To ensure compliance with these rules, we may monitor or record your activity. If you don’t follow these rules, we may remove your access, account, or content from the Services, temporarily or permanently, with or without notification or warning before taking such action. 

 

If you encounter another user suspected of violating any of these rules, please report this activity to us by contacting Customer Support (support@2sodas.com).

 

6. Termination and Other Sanctions

 

If you break this Agreement, we may suspend or terminate your use of our Services, without refunds and without notification. 

 

This Agreement is effective until terminated by you or 2 Sodas. If we determine that you have violated this Agreement or that there has been otherwise unlawful, improper, or fraudulent use of our Services on your Account, we may terminate your access and use of any Services, Content, and Entitlements, with or without prior notification.You will not be entitled to a refund (subject to any statutory refund rights) and no Entitlements will be credited to you or converted to cash or other forms of reimbursement.

 

If you believe that any action has been taken against you in error, please contact Customer Support (support@2sodas.com).

 

If you terminate this agreement, you agree to cease all use of Services.  Upon termination, your license under this Agreement also shall terminate, except that Sections 3 and Sections 6-10 of this Agreement survive termination.

 

7. Use of Data

 

We collect various information when you play our games or access our Service, in order to operate our business, improve our products and services, enforce our rules, and communicate with you.

 

Your data is collected, used, stored and transmitted in accordance with our 2 Sodas Privacy Policy, which is also incorporated by reference into this Agreement.
 

8. Third Parties

 

Certain aspects of our Services are hosted by or dependent on third parties not in 2 Sodas control.  

 

Our Services may rely on third parties for certain functions, for example support and community functions may be hosted in a Discord channel, or our games or Services may include hyperlinks to third-party websites. Those third parties may collect data or solicit personal information from you. 2 Sodas does not control those third parties, and is not responsible for their content or for their collection, use, or disclosure of personal information.

 

9. Warranties, Indemnification, and Limitation of Liability

 

We do not make any promises, but the local law where you live may include certain warranties. 

 

TO THE FULL EXTENT PERMITTED UNDER APPLICABLE LAW, 2 SODAS GIVES NO EXPRESS, IMPLIED OR STATUTORY WARRANTIES, INCLUDING IMPLIED WARRANTIES OF SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, NONINFRINGEMENT OF THIRD-PARTY RIGHTS, AND WARRANTIES ARISING FROM A COURSE OF DEALING, USAGE OR PRACTICE. 2 SODAS DOES NOT WARRANT AGAINST INTERFERENCE WITH YOUR ENJOYMENT OF THE PRODUCT OR SERVICE; THAT THE SERVICE WILL MEET YOUR REQUIREMENTS; THAT OPERATION OF THE SERVICE WILL BE UNINTERRUPTED OR FREE FROM ERRORS, BUGS, CORRUPTION, LOSS, INTERFERENCE, HACKING OR VIRUSES, OR THAT SERVICES WILL INTEROPERATE OR BE COMPATIBLE WITH ANY OTHER SOFTWARE. UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL 2 SODAS OR ANY OF ITS OFFICERS, DIRECTORS, EMPLOYEES, SHAREHOLDERS, PROMOTION AGENCIES, AGENTS, SUCCESSORS, ASSIGNS, OR SERVICE PROVIDERS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE SERVICES, EVEN IF ANY OR ALL OF THE FOREGOING OR ANY OF THEIR AUTHORIZED REPRESENTATIVES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BY PARTICIPATING IN THE SERVICES, A PARTICIPANT WAIVES ANY AND ALL RIGHTS TO BRING ANY CLAIM OR ACTION RELATED TO SUCH MATTERS IN ANY FORUM BEYOND ONE (1) YEAR AFTER THE FIRST OCCURRENCE OF THE KIND OF ACT, EVENT, CONDITION OR OMISSION UPON WHICH THE CLAIM OR ACTION IS BASED. TO THE FULLEST EXTENT ALLOWABLE BY LAW, 2 SODAS AND ITS PROMOTION AGENCIES SPECIFICALLY DISCLAIM ANY REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE PRODUCTS AND/OR SERVICES OFFERED ON ANY THIRD-PARTY WEBSITE.

 

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (1) use of the Services; (2) breach of these Legal Terms; (3) any breach of your representations and warranties set forth in these Legal Terms; (4) your violation of the rights of a third party, including but not limited to intellectual property rights; or (5) any harmful act toward any other user of the Services with whom you connected via the Services. 

 

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DAMAGES OF ANY TYPE, CAUSE, OR CONSEQUENCE, ARISING FROM YOUR USE OF THE SERVICES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU WILL AT ALL TIMES BE LIMITED TO THE LESSER OF THE AMOUNT PAID, IF ANY, BY YOU TO US OR $1000. CERTAIN US STATE LAWS AND INTERNATIONAL LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.

10. General Terms

A. Entire Agreement

 

This Agreement can only be changed by reaching a new Agreement, in writing, signed by 2 Sodas.

 

This Agreement, together with any other terms that govern your use of 2 Sodas Services, constitutes the entire agreement between you and 2 Sodas, Inc., 25 Burgess Court, Sausalito, California 94965, United States. The Agreement may not be amended or modified unless made in writing and signed by 2 Sodas. The failure of 2 Sodas to exercise any right under this Agreement shall not constitute a waiver of the right or any other right. If any part of this Agreement is held to be unenforceable, all other parts of this Agreement shall continue in full force and effect.

B. Governing Law and Disputes

 

The laws of Marin County, California, United States apply, regardless of your country of residence.

 

The Agreement will be governed and construed in accordance with the laws of the State of California, irrespective of any principles of conflicts of law.  By creating an account and/or participating in any 2 Sodas games or Services, you agree that any dispute that cannot be resolved between the parties shall be resolved individually, without resort to any form of class action. 

 

You further agree that any dispute that cannot be resolved privately between you and 2Sodas shall be resolved pursuant to binding arbitration. If you live in the United States, arbitration will take place in the county in which you reside. For residents outside the United States, arbitration shall be initiated in the County of Marin, State of California, United States of America, and you and 2 Sodas agree to submit to the personal jurisdiction of that court, in order to compel arbitration, to stay the proceeding pending arbitration, or to confirm, modify, vacate or enter judgment on the award entered by the arbitrator.

 

To the extent any legal action arises, that legal action shall proceed only in the state or federal courts located in Marin County, California, or as otherwise determined by us, and you hereby submit to personal jurisdiction and venue in such courts for the purposes of litigating any such action.
